Non-Discrimination Notice effective January 1, 2017 - Section 1557 of the Affordable Care Act (ACA), considered the non-discrimination provision of the ACA, prohibits an employer that receives federal financial assistance and is principally engaged in health care, such as a hospital or clinic, from discriminating on the basis of age, gender, race, color, national origin, language, culture, sexual orientation, gender identity and/or expression, pregnancy or disability, when providing employee health benefits. Under Section 1557, Carilion Clinic cannot provide employee health benefits in a discriminatory manner; therefore, we cannot take any of the following related actions if they differentiate on the basis of age, gender, race, color, national origin, language, culture, sexual orientation, gender identity and/or expression, pregnancy or disability:
- Deny, cancel, limit or refuse to issue or renew an insurance policy;
- Deny or limit coverage of a claim, or
- Impose additional cost sharing or other limitations or restrictions
Section 1557 also prohibits Carilion from denying any claim, or imposing additional cost sharing or other limitations, on any health care services that are ordinarily or exclusively available to individuals of one gender, based on the fact that an individual’s sex assigned at birth, gender identity, or recorded gender is different than the one to which the health care services are ordinarily or exclusively available. Additionally, we cannot deny or limit coverage, or deny a claim for any health care services related to gender transition, if such denial or limitation results in discrimination against a transgender employee.

The Consolidated Omnibus Budget Reconciliation Act (COBRA) Overview (.pdf)—COBRA gives workers and their families who lose their health benefits the right to choose to continue group health benefits provided by their group health plan for limited periods under certain circumstances.

The Affordable Care Act (also known as healthcare reform) was signed into law in 2010. Many of the key provisions have already gone into effect; however, this law was designed to layer new features on a yearly schedule through 2018.

These changes took effect Jan. 1, 2015 unless otherwise noted.
- Employer Mandate. Under the Affordable Care Act (ACA), employers are required to offer affordable coverage to full-time employees or pay a penalty.
- For purposes of the ACA, employees who work an average of 30 hours per week are considered full-time. We will offer coverage under the medical plan at the full-time rates for any employee normally scheduled to work at least 30 hours per week or 60 hours per pay period.
- The ACA defines affordable as having an employee-only premium, including any wellness incentives, of not more than 9.5% of the employee's income. As a result, we have lowered the medical plan premium for employee-only coverage for non-tobacco users.
- Reporting Requirements. As part of the Affordable Care Act, the IRS requires us to report information about each person who is eligible for our medical plan. The IRS uses this information to determine whether our employees are offered affordable coverage and whether our employees and their family members are covered by insurance. The new reporting will require us to collect Social Security Numbers on all dependents covered by the Carilion Clinic Medical Plan. When you complete the Open Enrollment Checklist through My Total Access you will be asked to provide Social Security Numbers for any dependents you cover on your benefits. Please be sure to have this information ready when you complete the checklist.
- If the Social Security Number(s) is not provided for covered dependents during Open Enrollment, the employee will be contacted by Human Resources in an effort to collect this information.
